GRAD RULE CHANGES PROPOSED FOR SPECIAL CIRCUMSTANCES

Public may request hearing on rules

Roseville – The Minnesota Department of Education has proposed permanent rules for implementing and administering the Graduation-Required Assessment for Diploma (GRAD) in reading, mathematics and writing. These rules will streamline and clarify the GRAD assessments for students who have unique circumstances.

The Department was directed by the Minnesota Legislature in 2007 to adopt rules governing GRAD for students in unique circumstances. The Department already administers similar rules for the Basic Skills Tests in Minnesota Rules Chapter 3501. A copy of the proposed rules is available below.

The Department of Education intends to adopt these rules without a public hearing following the procedures in the rules of the Office of Administrative Hearings (Minnesota Rules, parts 1400.2300 to 1400.2310) and the Administrative Procedure Act (Minnesota Statutes, sections 14.22 to 14.28).

If 25 or more persons submit a written request for a hearing on the rules by 4:30 p.m. on Aug. 20, the Department will conduct a public hearing in September.

To submit written comments or request a hearing, please follow the requirements in the Dual Notice below, and submit your comment and/or hearing request to Sage Van Voorhis, rulemaking coordinator, at sage.vanvoorhis@state.mn.us, 651.582.8248 Fax or 1500 Highway 36 West, Roseville, MN 55113.

To inquire whether the Department will conduct the hearing, contact Van Voorhis at 651. 582.8571 or sage.vanvoorhis@state.mn.us after Aug. 20, 2008, and before Sept. 3. A Statement of Need and Reasonableness (SONAR) was prepared by the Department in support of these proposed rule changes and is available below. Please consult the Dual Notice for more information on this rulemaking process.
