Compliance and Assistance

The Division of Compliance and Assistance oversees the implementation of many laws. These include Special Education Complaints, Hearings, Compliance Monitoring and Mediation; Student Maltreatment Investigations; Test Security Investigations; Expulsion Appeals; State Arts High School Appeals; State High School League Review; Assurance of Compliance; and Civil Rights Compliance Reports. In addition, the division provides general rule making guidance for the Minnesota Department of Education as well as general compliance with the Minnesota Data Privacy Act.

Student Maltreatment

The Department of Education receives and investigates reports of alleged physical abuse, sexual abuse, and neglect of public school students by school employees pursuant to *Minnesota Statute Section 626.556. If appropriate, information from these investigations may result in a referral to local law enforcement, the Board of Teaching, county social service or back to the school itself.

Rulemaking

The legislature can delegate authority to state agencies to create rules that help the agency perform its duties. Rules guide agency practices and can be adopted through formal, exempt or expedited rulemaking, depending on which process the legislature wants the agency to use.
