Minnesota Rules, part 3512.5400

Subject Matter:

The No Child Left Behind Act of 2001 requires states to have an approved list of supplemental educational services providers who provide educational services to youth attending schools that have not met adequate yearly progress. The 2003 Minnesota Legislature required MDE to adopt exempt rules governing this topic at Minnesota Rules part 3512.5400. They became effective on September 8, 2003. However, because these rules are only effective for two years, the department is proposing permanent rules to replace those currently in effect, in accordance with 2004 Minnesota Laws, chapter 294, article 2, section 32.

Status:

The department published the Request for Comments in the State Register on June 14, 2004. A period of at least 60 days must follow before the department publishes the Notice of Intent to Adopt Proposed Rules. After this notice is published, there will be a 30-day comment period (minimum) before a hearing is held on the matter.

The department is requesting comments at this time as it is considering proposed amendments to the exempt rules currently in effect. Comments are most accurate and effective if they are in writing.
